Who Can File for Bankruptcy Relief?

Any person who resides in, who does business in, or who has property in the United States, may file under Chapter 7, except a person who has been involved in another bankruptcy case that was dismissed within the last 180 days on certain grounds.  A Debtor who has obtained a Chapter 7 Discharge from a case filed within the last six years may not receive another Chapter 7 Discharge. There are no such restrictions on Chapter 13 filings, although there are certain rules which may affect such filing, so the attorney must be made aware of all previous filings, just in case
